Company profile

Delphi Automotive Systems, L.L.C. — legacy U.S. operating entity of Delphi, the automotive supplier spun off from General Motors and taken public in May 1999 (NYSE: DPH), headquartered in Troy, Michigan. Delphi Corporation filed Chapter 11 in October 2005; on emerging in October 2009 the remaining shell was renamed DPH Holdings Corporation to wind down, while the core businesses were sold to Delphi Automotive LLP, later Delphi Automotive PLC (IPO 22 Nov 2011; NYSE: DLPH). That company became Aptiv PLC (NYSE: APTV) on 4 December 2017 and spun off Delphi Technologies, which BorgWarner acquired in 2020. "Delphi Automotive Systems, LLC" survives as an Aptiv U.S. entity; Aptiv filings use it as the c/o addressee at 5725 Delphi Drive, Troy, Michigan. Aptiv reported $19.7B FY2024 net sales and roughly 141,000 employees — group-level figures, not figures for this LLC. Note: the entity named in the litigation below pre-dates the 2009 asset sale, so it should not be conflated with today's Aptiv subsidiaries.

Operations. This is an operating company, not a patent assertion entity. Legacy Delphi designed and manufactured automotive electrical/electronic architecture, wiring and connectors, steering, thermal, powertrain and safety electronics — including its "Passive Occupant Detection System" (PODS) seat sensors. Aptiv's successor business reports two segments: Signal and Power Solutions (vehicle electrical architecture, connectors, high-voltage harnesses) and Advanced Safety and User Experience (ADAS software and compute platforms). It supplies most of the world's largest OEMs.

Litigation posture. Defensive: 0 cases as plaintiff, 1 as defendant. Delphi was sued by Automotive Technologies International, Inc. (ATI), a New Jersey company founded in 1998 by inventor David S. Breed and classified as a patent asserter in Stanford's NPE database; ATI later assigned much of its portfolio to American Vehicular Sciences, an Acacia Research subsidiary.

Notable case. Automotive Technologies International, Inc. v. Delphi Corporation et al., No. 2:08-cv-11048 (E.D. Mich., filed 11 Mar 2008), consolidated with No. 10-cv-10647. ATI had sued Delphi's OEM customers (GM, Ford, Mercedes-Benz and others) over PODS patents; Delphi filed a declaratory-judgment action in Michigan, where the Texas case was consolidated. In 2011 the court granted summary judgment invalidating the four remaining patents-in-suit ('516, '029, '945, '080); ATI appealed (Fed. Cir. No. 11-1292).

On March 9, 2011, the court granted summary judgment of invalidity on all four patents, including '516 as anticipated by Blackburn '243; the case was consolidated with 2:10-cv-10647 and appealed.
