Scott Border

Scott Border is a patent litigation attorney with a focus on defending operating companies in complex intellectual property disputes. His practice encompasses a wide range of high-technology fields, including consumer electronics, software, wireless communications, artificial intelligence, digital rights management, and secure communication technology. He consistently represents defendants, having appeared on the defendant side in all three of his tracked cases, aligning with his defense-oriented practice.

Currently, Mr. Border is an attorney at Fenwick & West LLP, having joined the firm in May 2026 from Winston & Strawn LLP. His prior experience also includes roles at Sidley Austin LLP and Jones Day. Notable case work includes representing Microsoft in litigation against IPA Technologies concerning Cortana virtual-assistant technology, a matter which settled following a significant jury verdict. He has also been involved in cases such as Nintendo Co., Ltd. et al. v. Resonant Systems Inc. and Unified Patents v. US Well Services LLC.

Mr. Border possesses extensive experience in inter partes review (IPR) proceedings before the Patent Trial and Appeal Board (PTAB), frequently serving as a go-to attorney for such matters. He has been admitted pro hac vice in numerous IPR cases, particularly for Microsoft, demonstrating a deep familiarity with PTAB practice and the subject matter involved. He earned his J.D. from the University of Virginia School of Law in 2007 and was admitted to practice in Washington, D.C. in 2008.
