Clark Theodore Gordon

Clark Theodore Gordon is a seasoned patent litigator with extensive experience in federal courts, before the Patent Trial and Appeal Board (PTAB), and at the International Trade Commission (ITC). He is currently Counsel at Fabricant Rubino Lambrianakos LLP. His practice spans a diverse range of technologies, including computer hardware and software, display devices, standard essential technology (e.g., video, Wi-Fi, memory, 5G), networking systems, medical devices, and aerospace systems.

Mr. Gordon primarily represents patent owners and inventors in complex, multi-defendant litigations. His experience leans heavily plaintiff-side, having represented plaintiffs in four of his six tracked appearances. Prior to joining Fabricant Rubino Lambrianakos LLP, he was counsel at Akin Gump Strauss Hauer & Feld LLP, focusing on patent litigation.

He has played critical roles in securing significant outcomes for clients, including settlements and licenses totaling well in excess of nine figures. Notably, Mr. Gordon represented Smart Speaker LLC in patent infringement litigation against Amazon.com Services LLC, a matter in which his firm secured a seven-figure jury verdict over microphone technology used in Echo smart speakers. He also represents clients in patent enforcement campaigns related to memory and semiconductor technology against major consumer electronics companies.

Mr. Gordon possesses significant experience with post-grant proceedings, including IPRs, defending clients like Smart Speaker LLC and VIZIO, Inc. in related IPRs, and his firm has successfully defeated numerous IPRs for other clients across various technologies. He is admitted to practice in California and holds a master's degree in engineering mechanics from Columbia University.
