Bryan C. Nese

Bryan C. Nese is a partner in the Intellectual Property group at Mayer Brown's Washington D.C. office, specializing in complex patent litigation across district courts and the International Trade Commission (ITC). With a background in mechanical engineering, he handles a broad range of technologies, including computer products and peripherals, image sensors, automotive technology, medical devices, electromechanical devices, and consumer products. His technical expertise also spans areas like digital image processing, GPS navigation, cellular transmission, audio processing, and tire pressure monitoring technology.

While his tracked appearances show two cases on the plaintiff side, including Maxell, Ltd. v. Lenovo Group Ltd. et al., his practice extends to representing both patent holders in affirmative recovery actions and defendants. Notably, Mr. Nese was part of the Mayer Brown team that secured a $111.7 million jury verdict for Maxell Ltd. against Samsung Electronics Co. Ltd. in the Eastern District of Texas for willful infringement of patents covering smart device technologies. He also successfully defended Autel Intelligent Technology Corp. in a patent litigation concerning tire pressure monitoring technology, where a judgment of non-infringement was entered in the Eastern District of Texas, overturning a prior $6.6 million jury verdict. Other outcomes include obtaining a complete victory of no infringement on summary judgment for a dietary supplement patent and a jury verdict of no patent infringement in a declaratory judgment action involving a coenzyme Q10 manufacturing process.

Mr. Nese has significant experience with inter partes review (IPR) proceedings before the Patent Trial and Appeal Board (PTAB). He has conducted prior art searches, assisted in drafting IPR petitions, served as a technical lead in IPRs defending patent validity, and successfully invalidated challenged claims of a non-practicing entity's patent for a Fortune 100 company.

He is a registered patent attorney and is admitted to practice in D.C., New York, and New Jersey. Mr. Nese earned his J.D. from The George Washington University Law School in 2009, an M.S. in Mechanical Engineering from The Pennsylvania State University in 2006, and a B.S. in Mechanical Engineering, magna cum laude, from Rowan University in 2004.
