Company overview. Apotex Inc. (commonly "Apotex"; the database lists it as "Apotex Pharmaceuticals") is a Canadian generic pharmaceutical company headquartered at 150 Signet Drive, Toronto, Ontario. It was founded in 1974 by Barry Sherman and is Canada's largest generic drugmaker. Historically private, Apotex was acquired by New York private-equity firm SK Capital Partners (closing announced April 2023) and, per press reports, recently listed on the Toronto Stock Exchange under the ticker APTX, with SK Capital remaining majority shareholder. Reported scale varies by source — roughly 6,000–11,000 employees, annual sales around US$1–3 billion, and fiscal-2026 net income of about CAD $373.8 million.
Products / operations. Apotex develops, manufactures, and distributes generic pharmaceuticals and consumer health products, producing roughly 300–800 generic drug products in thousands of dosage forms and filling about one in five prescriptions in Canada. Operations span research and development, manufacturing, and sales/marketing, with dedicated subsidiaries including Apobiologix (biosimilars) and Global Active Pharmaceutical Ingredients (GAPI), Canada's largest API manufacturer. It exports to more than 70–115 countries.
Patent-litigation posture. Apotex is an operating company, not an NPE. Its single tracked case — 1 as plaintiff, 0 as defendant, in PTAB — reflects its role as petitioner in an inter partes review, consistent with its long history of challenging brand-name patents to clear the way for generic launches.
Notable case. The tracked matter is Apotex Inc. et al. v. Novartis AG (IPR2017-00854, filed Feb. 3, 2017), an IPR of U.S. Patent No. 9,187,405 covering a method of treating relapsing-remitting multiple sclerosis with 0.5 mg daily fingolimod (Gilenya®) without a loading dose. Apotex served as lead petitioner among several generic manufacturers; the PTAB instituted review but issued a final written decision in July 2018 upholding all claims as patentable, after which Novartis sued Apotex and others in Delaware over generic fingolimod.
