Company profile

Bristol-Myers Squibb Company (commonly "Bristol Myers Squibb" or "BMS") is a public multinational biopharmaceutical company listed on the NYSE under ticker BMY. The modern company was formed by the 1989 merger of Bristol-Myers and Squibb, tracing its roots to 1887. Headquarters are in Princeton, New Jersey (the company relocated its corporate base there from New York). It is a standalone public company, not a subsidiary. Per its own 2024 results and company fact sheet, revenue was roughly $48.3 billion in 2024 with about 34,000 employees.

Operations. BMS discovers, develops, manufactures, and commercializes branded prescription medicines and biologics, with core franchises in oncology, hematology, cardiovascular, and immunology/inflammation. Major marketed products include Opdivo (nivolumab) and Yervoy (ipilimumab) in immuno-oncology; Eliquis (apixaban) in cardiovascular; Orencia and Sotyktu in immunology; and the Celgene hematology portfolio — Revlimid (lenalidomide), Pomalyst (pomalidomide), and Thalomid (thalidomide) — plus Abraxane, Reblozyl, Breyanzi, and Zeposia. It is an operating company with substantial R&D, manufacturing, and commercial infrastructure, not an NPE.

Litigation posture. In the tracked data BMS appears exclusively as a defendant (3 cases, 0 as plaintiff), consistent with an operating company being sued. Notably, all three tracked matters are antitrust suits rather than patent-infringement actions, and all arise from the Celgene multiple-myeloma franchise. Two are venued in the District of New Jersey; one is in S.D.N.Y. — neither is an especially plaintiff-friendly patent venue.

Notable matters. The largest is In re Thalomid and Revlimid Antitrust Litigation (D.N.J.), followed by In re Pomalyst (pomalidomide) Antitrust Litigation (S.D.N.Y.) and Blue Cross Blue Shield Association plaintiffs v. Celgene Corporation et al. (D.N.J.), brought by Blue Cross plans. These challenge alleged exclusionary marketing and generic-entry conduct around Revlimid, Pomalyst, and Thalomid — the products BMS acquired through its $74 billion Celgene acquisition, completed in November 2019. I did not verify current case status or outcomes.

Blue Cross Blue Shield Association plaintiffs v. Celgene Corporation et al.

Antitrust action by Blue Cross Blue Shield Association plaintiffs against Celgene/BMS concerning Revlimid settlements; patents cited include the same Revlimid patent set as the In re Revlimid litigation.
