Will Melehani

Will Melehani is a patent litigation attorney primarily focused on defending companies in intellectual property disputes, particularly within the technology and life sciences sectors. His practice encompasses a broad range of technologies, including computer, internet, software, display, and touch panel technologies, often involving complex subject matter eligibility challenges under Section 101 of the Patent Act. Out of six tracked appearances, five have been on the defendant side, underscoring his preference for representing accused infringers.

Melehani is a Partner at Orrick, Herrington & Sutcliffe, where he has handled the majority of his tracked cases. He was also associated with Holland & Knight. A notable case includes representing BOE Technology Group Co., Ltd. as a defendant in Paneltouch Technologies LLC v. BOE Technology Group Co., Ltd., a patent infringement suit concerning touch panel and display technologies, which concluded with a stipulated dismissal with prejudice. Other significant defense results include a complete defense verdict for MobileIron, Inc. in a patent infringement lawsuit, and successfully obtaining a ruling that a software patent was ineligible under Section 101 for Nintendo Co., Ltd., which was later upheld on appeal at the Federal Circuit.

His experience extends to appellate work, having served on the team that sought to preserve a PTAB ruling for Ericsson, which found that state universities waive sovereign immunity from IPRs upon asserting challenged patents in district court. Melehani is admitted to the State Bar of California and several federal courts, including the United States Court of Appeals for the Federal Circuit. He earned his B.S. in Genetics from the University of California, Davis, and his J.D. from the University of California, Berkeley School of Law.
