Warren J. McCarty, III

Warren J. McCarty, III is a seasoned patent litigator with a strong record of representing plaintiffs in high-stakes intellectual property disputes. He currently serves as the managing partner of AZA's Dallas office and is a partner in its intellectual property group. His prior experience includes serving as a Principal at the Dallas-based trial firm Caldwell Cassady & Curry, where the majority of his tracked patent litigation appearances originate.

Mr. McCarty's practice emphasizes plaintiff-side patent enforcement, with all five of his tracked appearances on behalf of plaintiffs. His work spans diverse technology areas, notably including mercury emissions-control technology in the power industry, as evidenced by his involvement in the Midwest Energy Emissions Corp. cases. He has also handled matters involving high-tech cases, including electrical engineering, computer science and architecture, signal processing, telecommunications, medical devices, and oilfield technology.

He has played pivotal roles in securing significant verdicts and settlements. At Caldwell Cassady & Curry, he contributed to a $502.8 million damages verdict for VirnetX Inc. against Apple Inc. in 2020. More recently, he was involved in securing a $57 million patent infringement verdict for Midwest Energy Emissions Corp. against CERT-entity defendants for mercury sorbent technology, a case recognized among the Top 100 Verdicts of 2024. He also successfully led the trial team for SVV Technology Innovations Inc., resulting in a $10.3 million patent infringement verdict against Acer Inc. In his current role at AZA, he has served as co-lead counsel in a $78 million patent infringement verdict against Samsung involving automatic content recognition software. While his firms have demonstrated experience before the Patent Trial and Appeal Board (PTAB) on behalf of patent owners, specific details of Mr. McCarty's individual PTAB appearances were not readily available.
