Thomas S. Fletcher

Thomas S. Fletcher is a Partner at Williams & Connolly LLP, focusing his practice on patent litigation and licensing disputes, primarily within the biotechnology and pharmaceutical sectors. His experience encompasses Hatch-Waxman trials, proceedings under the Biologics Price Competition and Innovation Act (BPCIA), and appellate proceedings before the Court of Appeals for the Federal Circuit.

Fletcher generally represents plaintiffs, with four of his five tracked appearances on the plaintiff side. His significant plaintiff-side work includes representing Regeneron Pharmaceuticals, Inc. in several cases concerning its Eylea® (aflibercept) product and biosimilars, such as actions against Mylan Pharmaceuticals Inc., Formycon AG, Celltrion, Inc., and Sandoz Inc. While predominantly plaintiff-focused in district court, he has also appeared on the defendant side and represented clients like Bayer in patent infringement suits.

Notable recent engagements include his role in Regeneron Pharmaceuticals, Inc. v. Mylan Pharmaceuticals Inc. et al., Regeneron Pharmaceuticals, Inc. v. Formycon AG, and Regeneron Pharmaceuticals, Inc. v. Celltrion, Inc. In these cases, Regeneron secured preliminary injunctions against Mylan, Formycon, and Celltrion related to aflibercept biosimilars, which are currently undergoing expedited appeals. However, the Federal Circuit affirmed a district court's denial of a preliminary injunction for Regeneron against Amgen in a related matter.

Fletcher also possesses experience in inter partes review (IPR) proceedings before the Patent and Trademark Office (PTO). His work in this area includes representing a biotechnology company in IPRs concerning patents related to an antibody drug, and representing Petroleum GeoServices in IPRs against WesternGeco regarding seismic surveying technology.

He earned his J.D. from the University of California at Berkeley School of Law (Boalt Hall) in 2007, where he was elected to the Order of the Coif, and holds a B.S., with honors, in Chemistry and Economics from the California Institute of Technology (2004). Prior to joining Williams & Connolly in 2009, he clerked for Judge Ronald M. Whyte of the United States District Court for the Northern District of California. He was admitted to the State Bar of California in 2009.
