Thomas J. Wimbiscus

Thomas J. Wimbiscus is a highly experienced patent litigation attorney and a Shareholder and member of the Executive Committee at McAndrews, Held & Malloy. He specializes in intellectual property litigation, with a particular focus on patent matters, and has more than three decades of experience. His practice spans diverse technology areas, including semiconductors for cellular telephones (Wi-Fi and GPS technologies), computer memory devices, pharmaceutical and biotechnologies (including prodrugs and medical devices like implantable glucose monitors, cardiac defibrillators, pacemakers, and balloon angioplasty catheters), and chemical arts such as polyurethane and surfactants. He also handles cases involving multimedia over Coax (MoCA) technologies.

While Mr. Wimbiscus has secured patent infringement defense victories before the U.S. International Trade Commission, his overall practice demonstrates a strong emphasis on asserting patent rights for operating companies, with two tracked appearances on the plaintiff side as lead counsel. He was named one of the 10 most active IPR practitioners in the U.S. for patent owners, further highlighting his role in enforcing patent rights.

He has a robust track record of notable litigation successes, including multiple multi-million-dollar awards and settlements. Mr. Wimbiscus served as lead trial counsel for Broadcom in patent litigations against Qualcomm, Inc., resulting in a global campaign settlement of $891 million. He was also co-trial counsel in a four-week jury trial that led to an over $80 million patent infringement award with a finding of willful infringement. More recently, he was counsel in an offensive action that achieved a successful jury verdict in March 2024 for infringement of twelve patents on wearable continuous glucose monitoring systems. He also secured two jury trial victories in 2019 and 2020 for T.Q. Delta, LLC, finding patents on DSL technology valid and infringed.

Mr. Wimbiscus is also highly active in post-grant proceedings, having appeared in over 100 inter partes reviews (IPRs). His PTAB abilities are "extremely well regarded," and he is recognized as one of the "star quarterbacks" in McAndrews' "flourishing post-grant practice" by IAM Patent 1000. He is admitted to practice before the U.S. Patent and Trademark Office, various U.S. District Courts, various Appellate Courts, the U.S. Court of Appeals for the Federal Circuit, and the U.S. Supreme Court. He earned his J.D., magna cum laude, and a B.S. in Chemistry, with honors, from the University of Illinois.
