T. Earl LeVere

T. Earl LeVere is a highly experienced patent litigation attorney and a Partner at Ice Miller LLP, where he has practiced since January 2012. Prior to joining Ice Miller, he was a partner at Schottenstein Zox & Dunn Co., LPA, and Bricker & Eckler LLP. His practice focuses broadly on intellectual property and information technology issues, encompassing patents, copyrights, trademarks, life sciences, computers, internet, e-commerce, and entertainment. Ice Miller's patent team, of which Mr. LeVere is a part, has significant experience across diverse technologies including life sciences, electrical, and computer technologies, and the pharmaceutical industry.

Mr. LeVere primarily represents defendants in patent litigation. His experience includes successfully defending operating companies against infringement claims, as evidenced by his appearance for defendants MWE Investments, LLC and Midwest Equipment Sales, LLC in Champion Power Equipment, Inc. v. MWE Investments, LLC, a patent infringement suit that concluded with a voluntary dismissal. He was also part of the Ice Miller team that secured a significant Federal Circuit victory affirming the invalidity of asserted patent claims related to food processing technology in J.R. Simplot Co. v. McCain Foods USA, Inc.

His notable outcomes include defending a motorcycle aftermarket parts manufacturer in a California patent infringement suit, which resulted in an arbitration award that found the competitor's claims "exceptional" and ordered the competitor to pay over $550,000 in attorneys' fees and costs. Additionally, Mr. LeVere successfully obtained summary judgment of non-infringement and patent invalidation for an online service in a dispute concerning automobile lease technology, and secured nearly $600,000 in attorneys' fees and costs for clients in a software copyright infringement suit.

Mr. LeVere's practice extends to proceedings before the Patent Trial and Appeal Board (PTAB), where Ice Miller's IP team handles inter partes and post-grant reviews, as well as appeals to the Federal Circuit. He is admitted to the Ohio Bar and practices in numerous federal district and appellate courts, including the Supreme Court of the United States and the United States Court of Appeals for the Federal Circuit. He earned his B.A., summa cum laude, from Capital University in 1990 and his J.D., with honors, from The Ohio State University Moritz College of Law in 1994.
