Scott W. Hejny

Scott W. Hejny is a principal in the Dallas office of McKool Smith, focusing his practice on high-stakes patent litigation and complex commercial disputes. His experience spans a variety of technology areas, including wireless phone and data transmission, integrated circuitry, operating system software, environmental control systems, and pharmaceutical technologies. Prior to his legal career, he worked as a patent agent, drafting and prosecuting patent applications for electrical and mechanical systems, and as a design engineer for an oilfield services company.

Hejny has experience representing both plaintiffs and defendants in patent disputes across federal courts. While his tracked cases show more appearances on the defendant side (3 cases), he has also served as lead counsel for a plaintiff (1 case). Notable representations include Nokia Technologies Oy as a defendant against Unified Patents, LLC, and as both plaintiff and defendant in patent infringement cases involving Nokia Technologies Oy against Hisense Co., Ltd. et al. and Acer Inc. He also represented Bedrock Computer Technologies, LLC as trial counsel in a patent infringement action against Google, which resulted in a jury verdict in favor of Bedrock and subsequently settled.

He has provided commentary on PTAB policy changes and their implications for patent challenges. For instance, he represented Nokia Technologies Oy as the patent owner in IPR proceedings initiated by SNAP Inc. and Hisense USA Corporation, which concluded with settlements.

Hejny earned his J.D., cum laude, from the University of Houston Law Center in 2002, and holds an M.S. in Mechanical Engineering from Rice University and a B.S., magna cum laude, in Aerospace Engineering from Texas A&M University. He is admitted to practice in the State of Texas and before the U.S. District Courts for the Northern and Eastern Districts of Texas, as well as the U.S. Patent and Trademark Office.
