Philip P. Caspers

Philip P. Caspers is a founding partner at Carlson Caspers IP Litigation & Counseling, where his practice is concentrated on complex, high-technology patent litigation. His technical expertise, stemming from a background in physics and electrical engineering, underpins his work across diverse sectors including telecommunications infrastructure, wireless OFDM technology, photoelectric sensors, medical devices, pharmaceuticals, software, and cable TV headends.

Throughout his career, Mr. Caspers has primarily represented plaintiffs and patent holders. His tracked cases, including Element Television Co., LLC v. Nokia Corp., reflect this focus, with two recorded appearances on the plaintiff side and none on the defendant side. He has secured notable outcomes for clients, including a $30 million judgment in a telecommunications infrastructure patent case and an impressive $75 million result for ADC Telecommunications involving wireless OFDM technology. He also obtained a settlement with a complete injunction in litigation enforcing ADC patents related to cable TV headends against PCI Technologies. Earlier in his career, Mr. Caspers was part of a team that successfully tried a patent case for Banner Engineering, invalidating a patent and recovering attorney fees.

Mr. Caspers is highly active in post-grant proceedings, having served as lead counsel in over one hundred such matters before the USPTO, including Inter Partes Reviews (IPRs) and Post Grant Reviews (PGRs). He is admitted to practice before the Minnesota Supreme Court, the U.S. District Court for the District of Minnesota, and the U.S. Court of Appeals for the Federal Circuit. He earned his J.D., cum laude, from the University of Minnesota Law School in 1988, and a B.A. in Physics, summa cum laude, from Hamline University in 1984, followed by graduate coursework in Electrical Engineering at the University of Minnesota.
