Paul E. Torchia

Paul E. Torchia is a highly experienced patent litigator currently serving as a partner in the New York office of Gibson, Dunn & Crutcher. His practice spans a diverse range of technical fields, including computer hardware and software, telecommunications, wireless networking, medical devices, and pharmaceuticals. He frequently represents leading high technology and life science companies such as Dell, EMC, Roku, Cloudera, Infor, Novartis, Sun Pharma, and Gilead.

Mr. Torchia primarily focuses on defending operating companies against patent infringement allegations, with all tracked appearances on the defendant side. He has served as lead counsel in significant patent disputes, including representing Dell in complex patent infringement cases brought by Cloud Byte LLC concerning data center server technologies, networking products, RAID technology, and advanced thermal management systems.

His notable achievements include securing a $14 million jury verdict for EMC against Pure Storage in the District of Delaware and achieving a highly favorable settlement for AppDynamics in intellectual property cases against CA Technologies, which preceded AppDynamics' $3.7 billion acquisition by Cisco. Mr. Torchia also successfully argued an expedited appeal before the Federal Circuit for Sun Pharma, resulting in the vacation of a preliminary injunction related to an alopecia drug, an outcome that garnered "Litigator of the Week Runners-Up" and "Legal Lions" honors. Additionally, he won a complete summary judgment of non-infringement for Dell EMC in a long-standing dispute with ACQIS, later affirmed by the Federal Circuit, which also upheld an "exceptional case" finding and a $4 million attorney fee award.

Mr. Torchia maintains an active practice before the United States Patent Office, where he has successfully litigated numerous Inter Partes Review (IPR) proceedings for both patent owners and challengers. He has been recognized by Patexia as a "Top IPR Attorney" for his activity and performance in these proceedings. He earned his B.S. in Biochemistry from the University of Maryland in 1997 and his J.D., cum laude, from Cornell University Law School in 2000. He is admitted to practice before the U.S. Supreme Court, the Federal Circuit, and the USPTO.
