Nathan Robert Curtis

Nathan Robert Curtis is an experienced patent litigator with a strong focus on defending operating companies in complex intellectual property disputes. His practice encompasses a broad spectrum of technologies, including computer architecture, telecommunications, networking, communications standards and protocols, digital signal processing, consumer products, medical devices, semiconductors, and steel manufacturing. He has successfully defended clients in the nation's most active patent venues, including the Eastern and Western Districts of Texas, the Northern District of California, the District of Delaware, the International Trade Commission, and the Federal Circuit.

Currently Of Counsel in the Dallas office of Gibson, Dunn & Crutcher LLP, Mr. Curtis is a key member of the firm's Intellectual Property Practice Group. His prior experience includes roles at Fish & Richardson and Kellogg, Hansen, Todd, Figel & Frederick. His track record reflects a consistent defense-side preference, with all seven tracked appearances being on behalf of defendants.

Mr. Curtis has been involved in several notable cases. He represented Dell EMC in a multi-year patent dispute with ACQIS, securing a complete summary judgment of non-infringement on eight patents, defeating ACQIS's appeal at the Federal Circuit, and obtaining a $4 million attorney-fee award that was affirmed on appeal. This victory followed ACQIS having previously obtained significant settlements from other technology companies. He also represented Dell Technologies in Cloud Byte LLC v. Dell Technologies, Inc. et al., a patent infringement lawsuit in the Eastern District of Texas involving networking and server technologies, where Dell has filed multiple Inter Partes Review petitions. Other successes include securing a favorable settlement for NetApp after invalidating most asserted patents against KOM Networks and forcing Actifio to dismiss its patent infringement lawsuit against Rubrik. While primarily defense-oriented, he also represented Sanofi Aventis in Hatch-Waxman lawsuits concerning diabetes treatments that resolved favorably.

In addition to district court litigation and Federal Circuit appeals, Mr. Curtis possesses extensive experience with patent review proceedings before the U.S. Patent & Trademark Office, including inter partes review (IPR) and reexamination proceedings. He is admitted to the State Bar of Texas, the United States Court of Appeals for the Federal Circuit, and is registered to practice before the U.S. Patent & Trademark Office. He earned his Juris Doctor summa cum laude from Brigham Young University, where he served as Editor-in-Chief of the Law Review, and holds a Bachelor of Science in Applied Physics, magna cum laude, also from Brigham Young University.
