Michael Johnson

Michael Johnson is a distinguished patent litigation attorney with a practice primarily focused on the life sciences sector, including pharmaceuticals, biotechnology, medical devices, industrial chemicals, and consumer products. He has extensive experience in Hatch-Waxman and Biologics Price Competition and Innovation Act (BPCIA) litigation. Johnson maintains a balanced practice, representing both plaintiffs and defendants, as evidenced by his equal number of tracked appearances on both sides of disputes. He is currently a Partner at Gemini Law.

Prior to joining Gemini Law in April 2025, Johnson was a partner at Willkie Farr & Gallagher LLP from 2006 to 2025 and began his legal career at Kenyon & Kenyon from 2000 to 2006. His notable engagements include representing Bio-Thera Solutions, Ltd. as a defendant in the BPCIA patent infringement suit Janssen et al. v. Bio-Thera, concerning golimumab biosimilars, filed in March 2026. He successfully represented Celltrion as a defendant against Amgen in a denosumab patent dispute that settled favorably, and secured a favorable outcome for plaintiff La Jolla in Hatch-Waxman litigation for its Giapreza product. Johnson also served as second-chair trial counsel for Hospira in Merck v. Hospira, where the court found Merck's ertapenem patent invalid, and successfully appealed a Hatch-Waxman action for Amneal regarding obviousness of oxycontin anti-abuse features. He is active in post-grant proceedings, having successfully represented Hospira in an IPR against a patent on Protein A affinity chromatography, leading to challenged claims being deemed unpatentable, and represented Array BioPharma in an IPR and subsequent appeal related to a Takeda compound patent.

Johnson is admitted to practice in New York, before the U.S. District Court for the Southern and Eastern Districts of New York, and the U.S. Court of Appeals for the Federal Circuit. He is also admitted to the United States Patent and Trademark Office. Recognized as a leading practitioner, he has been ranked in Chambers USA for Intellectual Property: Patent and by IAM Patent 1000 as a top patent litigator for multiple years.
