Michael E. Joffre

Michael E. Joffre is a highly experienced patent litigator and a Director at Sterne Kessler Goldstein & Fox, where he co-chairs the firm's Appellate Practice Group. He joined Sterne Kessler in January 2017, significantly strengthening the firm's patent litigation and appellate capabilities. His practice spans intellectual property disputes before trial and appellate courts, with a focus on a diverse range of technologies including microprocessors, telecommunications networks, mechanical devices, consumer products, computer software, and pharmaceutical matters related to Abbreviated New Drug Applications (ANDAs). His technical acumen is underpinned by a Ph.D. in astrophysics.

Joffre's litigation experience includes arguing and winning cases in numerous jurisdictions across the country, such as Texas, California, Wisconsin, Delaware, and New Jersey, as well as before the U.S. International Trade Commission and the U.S. Court of Appeals for the Federal Circuit. He has also represented clients before the U.S. Supreme Court at both the certiorari and merits stages. His firm's appellate practice has been involved in seminal patent law cases at both the Federal Circuit and Supreme Court levels, including Alice Corp. v. CLS Bank. In 2023, he was recognized among the "Best-Performing Patent Litigators Representing Plaintiffs" by Patexia, aligning with his plaintiff-side appearance in cases such as Excalibur IP, LLC v. Uber Technologies, Inc.

Michael Joffre is also active in post-grant proceedings, appearing before the U.S. Patent Trial and Appeal Board (PTAB). Sterne Kessler is noted as a leader in PTAB proceedings, having handled over 500 America Invents Act (AIA) proceedings, and is a recognized "go-to" firm for appeals stemming from the PTAB.

Mr. Joffre earned his J.D. from Harvard Law School, a Ph.D. in astrophysics from the University of Chicago, and a B.S. from the Massachusetts Institute of Technology. He previously served as a law clerk for Judge William C. Bryson on the U.S. Court of Appeals for the Federal Circuit.
