Lily Li

Lily Li is a prominent patent litigation attorney and a Partner in the Litigation Group and Intellectual Property practice at Morrison & Foerster, where she also serves as Head of Litigation in the Palo Alto office. Her practice is highly technical, spanning technologies such as semiconductors, artificial intelligence (AI), software and hardware systems, autonomous driving, wireless communications, medical devices, and pharmaceuticals. With an engineering background, including an M.S. in Electrical Engineering and published research in AI, she leverages deep technical fluency in complex disputes.

Li primarily defends operating companies in high-stakes patent, trade secret, copyright, trademark, and licensing disputes, including competitor cases and non-practicing entity (NPE) assertions. Her experience includes litigation in federal and state courts, the International Trade Commission (ITC), arbitration tribunals, and before the U.S. Patent and Trademark Office. Before entering private practice, Li held an in-house leadership role at a semiconductor company, managing patent prosecution, licensing strategy, and global intellectual property portfolio development.

A notable recent success includes her role as co-lead counsel for Insta360 in the ITC Investigation No. 337-TA-1400, brought by GoPro, Inc. In February 2026, Morrison & Foerster secured a complete defense victory for Insta360 on all five asserted utility patents, with the Commission finding Insta360's products did not infringe and/or the patent claims were invalid. While some older Insta360 models were found to infringe a design patent, the ruling confirmed that Insta360's current product lineup remained unaffected, preserving critical U.S. market access. She also has experience defending companies against patent infringement claims relating to OLED display technology and power management.

Li's practice also encompasses Post-Grant Strategy + Disputes, reflecting her engagement with proceedings before the U.S. Patent and Trademark Office, including the Patent Trial and Appeal Board (PTAB). She regularly appears before agencies and tribunals such as the ITC and PTAB. She is admitted to the California Bar and registered to practice before the U.S. Patent & Trademark Office. Li earned her J.D. from Santa Clara University School of Law, an M.S. from Ohio University, and a B.S. from Nanjing University of Science and Technology.
