Kevin D. Rodkey

Kevin D. Rodkey is a patent litigation partner at Finnegan, Henderson, Farabow, Garrett & Dunner, with a practice spanning patent litigation, prosecution, counseling, and transactions. His technical focus encompasses a broad range of electrical and mechanical technologies, including wireless technology, cellular communications (4G/LTE/5G), data processing, optical systems, mobile devices, consumer products, specialty materials, filtration systems, and packaging.

While Mr. Rodkey represents both plaintiffs and defendants in district court litigation and post-grant proceedings, his tracked appearances include representing Uber Technologies, Inc. on the defendant side. He has secured favorable outcomes for clients, including successfully defending Wintrust Bank in a patent infringement lawsuit that resulted in a motion to dismiss due to unpatentable subject matter, and achieving a favorable dismissal for FIS in a financial services case. He also obtained a complete victory on appeal for BMW Group, exonerating their ACC system against asserted patents following post-grant efforts and prior litigation successes.

Mr. Rodkey is particularly active in post-grant review proceedings, including inter partes review (IPR), having managed or assisted in more than eighty such proceedings for both petitioners and patent owners across diverse electrical and mechanical technologies. He is recognized for his instrumental role in Finnegan's PTAB practice and has co-authored analyses and participated in podcasts discussing PTAB developments and Federal Circuit decisions impacting IPRs.

He is admitted to practice before the U.S. Patent and Trademark Office, in Georgia, and before the U.S. Court of Appeals for the Federal Circuit. Mr. Rodkey earned his J.D., with honors, from George Washington University Law School in 2010, and an M.S. in Materials Science and Engineering from Georgia Institute of Technology in 2007.
