Kate Falkenstien

Kate Falkenstien is a Partner and trial lawyer at Blue Peak Law Group, specializing in patent, trade secret, and complex commercial litigation. Her practice encompasses a broad range of technologies, including semiconductors, hardware and software, consumer electronics, telecommunications, biotechnology, medical devices, life sciences, and pharmaceuticals. She has experience representing both plaintiffs and defendants, an approach reflected in her case history, which includes appearances for both sides.

Before joining Blue Peak Law Group, Ms. Falkenstien was a partner at Reichman Jorgensen Lehman & Feldberg LLP and an associate at McKool Smith. She also gained appellate experience clerking for Judge Sri Srinivasan on the D.C. Circuit.

Ms. Falkenstien has been involved in several high-stakes cases, including securing a $222 million jury verdict for trade secret misappropriation against Walmart in the Eastern District of Arkansas, where she cross-examined key witnesses. She also obtained a $236 million patent infringement verdict for Densify, Inc. against VMware, Inc. in the District of Delaware and secured a $15 million patent infringement verdict for Droplets, Inc. against Yahoo!, Inc. Her work includes achieving a confidential settlement with Amazon after prevailing on significant summary judgment and Daubert motions in patent litigation concerning the Alexa voice assistant.

Her firm, Blue Peak Law Group, has deep experience with Post-Grant Proceedings before the Patent Trial and Appeal Board (PTAB), including Inter Partes Review (IPR), Post-Grant Review (PGR), and Ex Parte Reexamination. Ms. Falkenstien is admitted to the State Bar of California and the State of Idaho. She earned her J.D. from Stanford Law School in 2015 and her B.S. in Psychology, magna cum laude, from Yale University in 2012.
