Justin Nemunaitis

Justin Nemunaitis is a Principal at Caldwell Cassady & Curry, focusing on patent infringement disputes and complex commercial litigation. His practice encompasses a broad range of technologies, including digital content distribution and protection, fiber optic networking, wireless communications standards (e.g., physical layer RF signaling, ARQ protocols, digital video compression), cybersecurity, and environmental technologies such as mercury emissions capture from coal-fired power plants. Nemunaitis also has experience with patent claims in the oilfield services industry. While his firm indicates representation for both plaintiffs and defendants, his tracked case appearances show a strong emphasis on plaintiff-side patent enforcement, with seven plaintiff appearances against two defendant appearances.

Currently a Principal at Caldwell Cassady & Curry, Nemunaitis previously practiced at McKool Smith. He has played a key role in numerous high-stakes patent litigation matters. Notably, he was part of the trial team that secured a $57 million jury verdict in March 2024 for Midwest Energy Emissions Corp. (now Birchtech Corp.) in Delaware for infringement of mercury emissions capture technology, which was later increased to an approximate $78 million judgment by December 2025. Nemunaitis was also on the legal team that achieved a $445.5 million patent infringement verdict for Collision Communications Inc. against Samsung in October 2025, involving wireless communication technology. His experience further includes contributing to a $532.9 million verdict for VirnetX against Apple Inc. and securing a multimilion-dollar verdict for Smartflash against Apple.

Nemunaitis is actively involved in Patent Trial and Appeal Board (PTAB) proceedings, having been recognized in the 2025 Patexia PTAB Intelligence Report among the top 10% of active and best-performing attorneys for patent owners. He has successfully defended clients, including Smartflash and ZitoVault, against attempts to invalidate their patents through post-grant review proceedings. More recently, his client Birchtech Corp. announced in June 2026 the termination of all remaining Inter Partes Review petitions challenging its core patents, solidifying its intellectual property position. He previously served as a Judicial Clerk for the Honorable Magistrate Judge John Love in the U.S. District Court for the Eastern District of Texas.
