Justin Adatto Nelson

Justin Adatto Nelson is a highly experienced patent litigator and a partner at Susman Godfrey LLP, where he has practiced since 2005. His practice is characterized by representing plaintiffs in high-stakes intellectual property disputes, often involving complex technologies. While his broader litigation experience spans antitrust, bankruptcy, and significant copyright cases related to artificial intelligence, his patent work focuses on semiconductor technologies, memory modules, and antenna/IoT connectivity.

Nelson primarily represents patent owners, with 15 tracked appearances on the plaintiff side compared to 2 on the defendant side. He has notably acted as lead counsel for non-practicing entities (NPEs) such as Advanced Memory Technologies, LLC, in disputes concerning semiconductor memory module patents, and Fractus, S.A., a pioneer in antenna technology. For Fractus, he secured a $38 million judgment in a case that later settled on appeal and has led a strategy resulting in over $100 million in recoveries.

Among his prominent patent cases, Nelson represented Advanced Memory Technologies, LLC, in litigation against SK Hynix Inc. regarding semiconductor memory module patents, where several inter partes review (IPR) petitions filed by SK Hynix were denied institution by the PTAB. He also represented Advanced Integrated Circuit Process LLC against Taiwan Semiconductor Manufacturing Company, Ltd., in a case involving semiconductor interconnect patents, which also saw IPR petitions filed by TSMC. Additionally, Nelson was involved in Fractus, S.A.'s patent infringement suits against Verizon Connect Inc. and Geotab Inc. over IoT-related antenna innovations, with the Verizon case reaching a settlement. His experience extends to defending patent owners in PTAB proceedings, as indicated by his appearance for Advanced Integrated Circuit Process LLC against Unified Patents.

Beyond patent litigation, Nelson is recognized for his role in securing a $787.5 million settlement for Dominion Voting Systems in its defamation suit against Fox News and a $64.5 million judgment for Green Mountain Glass, which was affirmed on appeal. He is also a leading attorney in artificial intelligence (AI) litigation, serving as co-lead counsel in significant AI copyright class actions. Nelson is a graduate of Yale University and Columbia Law School, where he was valedictorian, and clerked for Justice Sandra Day O'Connor at the U.S. Supreme Court and Judge J. Harvie Wilkinson of the U.S. Court of Appeals for the Fourth Circuit. He is a Fellow of the American Bar Association and the Texas Bar Association.
