Joshua L. Stern

Joshua L. Stern is a seasoned intellectual property litigator and a partner at Wilmer Cutler Pickering Hale and Dorr LLP, where he also serves as Co-Chair of the Post-Grant Proceedings Group. His practice encompasses complex commercial litigation and a broad range of technology areas, including medical devices, small molecule and biologic pharmaceuticals, nucleic acid detection, microprocessors, wireless location, data storage, and mobile phone software.

Stern represents clients on both the plaintiff and defendant sides in patent disputes, with his tracked appearances reflecting this balanced approach. He has appeared as counsel for defendants in cases such as Aerin Medical Inc. v. Neurent Medical Ltd. et al., a patent infringement matter involving medical devices for treating nasal airways, and as of counsel for plaintiffs in disputes like Neurent Medical Ltd v. CLARET EUROPEAN SPECIALTY LENDING COMPANY III, S.A R.L.

His significant engagements include his role as a senior lawyer for Intel in successful patent challenges in Waco, which received media attention. He was also involved in WilmerHale's representation of Gilead Sciences, securing a victory when the Patent Trial and Appeal Board (PTAB) denied institution of ten straight inter partes reviews (IPRs) related to Gilead's Hepatitis C product patents. Additionally, Stern contributed to a success for Unified Patents, where the PTAB invalidated all claims against a patent asserted across multiple district court cases.

Stern possesses extensive experience before the Patent Trial and Appeal Board, counseling clients and assisting with IPR proceedings. He has also co-authored articles examining PTAB guidance on multiple IPR petitions, highlighting his expertise in this area. Prior to joining WilmerHale, Stern was a litigation associate at Paul, Weiss, Rifkind, Wharton & Garrison LLP. He earned his JD from Harvard Law School, cum laude, in 2008, and his AB from Harvard College, magna cum laude, in 2005. He is admitted to practice in New York, New Jersey, the District of Columbia, the U.S. Court of Appeals for the Federal Circuit, and several U.S. District Courts.
