Joseph M. Mercadante

Joseph M. Mercadante is a patent litigator at Fabricant Rubino Lambrianakos LLP, a firm that recently rebranded from Fabricant LLP in March 2026. His practice focuses on patent disputes within the electronics sector, covering areas such as computer hardware and software, automotive technologies, telecommunications and networking, semiconductors, and LED display panels and lighting.

Mercadante represents both patent owners and defendants in high-stakes litigation. While his firm frequently represents plaintiffs and innovators against large corporations, his tracked case appearances include three on the defendant side and one on the plaintiff side. He has represented clients such as Advanced Coding Technologies LLC in litigation campaigns concerning video codecs, including defending against petitions filed by Unified Patents. He has also defended automobile manufacturers and consumer electronics companies in patent infringement lawsuits.

His experience extends to the Patent Trial and Appeal Board (PTAB), where he regularly appears in Inter Partes Review (IPR) proceedings. He has served as lead counsel in four IPRs for Harbor Island Dynamic LLC, involving semiconductor manufacturing techniques. Mercadante earned his J.D. from Seton Hall University School of Law in 2009 and holds a B.S. in Electrical Engineering from Villanova University (2006). He is admitted to practice in New York, New Jersey, and before the U.S. Patent and Trademark Office. He also served as a law clerk to Chief Judge Garrett E. Brown Jr. (Ret.) of the U.S. District Court for the District of New Jersey.
