John Holley

John Holley is a seasoned patent litigator with extensive experience in federal district courts and the U.S. International Trade Commission. He currently practices at Boies Schiller Flexner LLP, having previously served as a Principal at McKool Smith, where he was promoted to that role effective January 1, 2023. With an electrical engineering background, Mr. Holley focuses on complex patent infringement cases across a wide array of technologies, including software, hardware, display devices, telecommunications (optical networking, 3G, 4G LTE, ATSC-M/H), printer technologies, semiconductor devices, encryption, medical devices, and consumer electronics.

His practice reflects a balanced approach to patent litigation, representing both plaintiffs and defendants in high-stakes disputes. Among his tracked appearances, he has acted as counsel for the plaintiff in Autonomous Devices, LLC v. Tesla, Inc. and as a partner defending Tesla Inc. in Tesla Inc. v. Autonomous Devices LLC. At McKool Smith, he applied his technical expertise to provide strategic analysis for clients.

Mr. Holley is also experienced in post-grant proceedings, regularly appearing before the U.S. Patent and Trademark Office, including handling reexamination proceedings. Notably, he represented Autonomous Devices, LLC in a request for Director Review of a Final Written Decision in an Inter Partes Review (IPR) against Tesla, Inc., leading to a remand for further consideration by the Board.

Mr. Holley earned his law degree from South Texas College of Law in 1992 and is licensed to practice in Texas.
