Jennifer C. Bailey

Jennifer C. Bailey is a Shareholder at Erise IP, specializing in intellectual property law, with a significant focus on patent litigation and post-grant review proceedings. She leads Erise's patent prosecution group and has extensive experience across electrical, computer software, and electromechanical arts. Her technological expertise includes areas such as encryption and authentication, financial services, digital surveillance, payments systems, medical devices, and GPS systems. She joined Erise IP in 2013, bringing over a decade of prior experience developing patent portfolios and handling patent litigation, U.S. reexaminations, and European Patent Office oppositions at other full-service law firms.

In her litigation practice, Ms. Bailey has experience representing both plaintiffs and defendants. Her tracked cases include acting as lead counsel for Apple, Inc. in an untitled plaintiff-side matter, and serving as counsel for Apple Inc. on the defendant side in RFCyber Corp. v. Apple Inc. She was also lead counsel for Apple, Inc. as a petitioner in Apple, Inc. v. CPC Patent Technologies Pty Ltd, an IPR proceeding that concluded with an "Unpatentable" outcome for the patent owner.

Ms. Bailey is particularly recognized for her robust practice before the Patent Trial and Appeal Board (PTAB). She was lead counsel for the petitioner in the first inter partes review (IPR) ever filed under the America Invents Act (AIA), on behalf of Garmin. She has significant experience securing favorable outcomes for both petitioners and patent owners in post-grant proceedings, having gone three-for-three on IPRs for a global technology leader in smart card technology and obtaining denials of institution for a patent owner in two IPRs. Ms. Bailey has handled over 100 IPRs, with an estimated success rate of over 90% for institution and cancellation of all claims as lead counsel, and has been named one of the Top 25 Best Performing IPR Attorneys for Petitioners by Patexia. Chambers USA also ranks her for Intellectual Property: Patent Trial and Appeal Board.

Ms. Bailey earned her J.D. from the University of Missouri School of Law (Columbia) in 2001, following a B.S. in Mathematics from the University of Tennessee at Martin. She is admitted to practice in Tennessee (2001), Missouri (2002), Kansas (2007), before the U.S. Patent and Trademark Office (2003), and the Federal Circuit Court of Appeals (2005).
