Specialty & background

Heath Brooks is a seasoned intellectual property litigator at Wilmer Cutler Pickering Hale and Dorr LLP, where he focuses on a diverse range of patent disputes. His practice encompasses a broad array of technological fields, including internet content delivery networks, wireless communications, tire pressure monitoring systems, semiconductors, medical devices, and pharmaceuticals. While his tracked appearances include representing defendants in high-profile cases, his practice also demonstrates significant experience on behalf of patent owners and plaintiffs. Mr. Brooks rejoined WilmerHale in 2006, following a clerkship with the Honorable Alice M. Batchelder of the United States Court of Appeals for the Sixth Circuit.

In notable litigation, Mr. Brooks has represented clients in the cybersecurity sector, including defendants Cisco Systems, Inc. and Palo Alto Networks, Inc., in complex patent disputes initiated by Centripetal Networks. In Centripetal Networks, Inc. v. Cisco Systems, Inc., WilmerHale represented Cisco in a case that resulted in a substantial damages award against Cisco, which was later upheld on appeal in part. His involvement continued through appellate stages, including an application for an extension of time to file a petition for a writ of certiorari at the Supreme Court. In Centripetal Networks, LLC v. Palo Alto Networks, Inc. et al., he served as counsel for Palo Alto Networks in inter partes review (IPR) proceedings and subsequent appeals to the Federal Circuit concerning network security patents. The Federal Circuit ultimately vacated a PTAB decision of unpatentability in one appeal and affirmed another via a Rule 36 judgment.

Mr. Brooks is experienced in inter partes review (IPR) proceedings before the Patent Trial and Appeal Board (PTAB), where he has handled briefing and oral arguments for both patent owners, securing confirmation of patentability, and defendants, achieving findings of unpatentability. Beyond the Centripetal matters, his experience includes obtaining a record settlement exceeding two billion dollars as plaintiff's counsel in a patent litigation related to gastroesophageal reflux disease, and securing a verdict of over $100 million for a plaintiff in wireless technology patent litigation.

He is admitted to practice in the District of Columbia and New York. Mr. Brooks earned his J.D., cum laude, from Harvard Law School in 2003, and his B.A., summa cum laude, in History and Political Science from West Virginia University in 2000.
