Harper Batts

Harper Batts is a highly experienced intellectual property litigator with over two decades of experience, specializing in complex patent disputes. His practice spans a diverse array of technology sectors, including semiconductors, software, video streaming, wireless technology, telecommunications, e-commerce, medical devices, and hardware technology. He is a partner at Sheppard, Mullin, Richter & Hampton LLP, where he notably leads the firm's Post Grant Proceedings (PTAB) Group and Semiconductor Industry Team.

Mr. Batts primarily represents operating companies, often serving on the defendant side or as a patent challenger in proceedings designed to invalidate patents. While his tracked case appearances show involvement on both plaintiff (2) and defendant (1) sides, his professional profiles highlight his work defending Fortune 500 clients in high-exposure cases. He joined Sheppard Mullin in 2018 from Baker Botts, and also previously appeared with Fish IP Law.

He possesses extensive experience before the Patent Trial and Appeal Board (PTAB), having represented both patent challengers and owners in nearly a hundred Inter Partes Review (IPR) proceedings. Prior to the 2025 discretionary denial process, he achieved an institution rate exceeding 90% on IPRs he filed. Mr. Batts has a strong litigation record, including winning nine out of ten appeals at the Federal Circuit Court of Appeals in the last two years and securing an exceptional case finding and an award of attorney's fees in 2020. His notable engagements include representing Marvell Semiconductor, Inc. as a plaintiff in patent disputes against Credo Technology Group Ltd. and defending clients in cases such as Election Systems & Software, LLC v. Hart InterCivic Inc.. He also achieved favorable outcomes in IPRs for a major streaming service and a gaming technology company, leading to patent claim invalidations and affirmed attorney's fees.
