Edmund Hirschfeld

Edmund Hirschfeld is a Senior Associate in the Supreme Court and Appellate Practice at Orrick, Herrington & Sutcliffe, where he focuses on high-stakes appeals across federal and state courts. His practice encompasses a broad range of legal issues, including patent, constitutional law, and complex commercial litigation. He has also counseled Fintech clients on novel industry issues.

In his patent litigation practice, Mr. Hirschfeld demonstrates experience representing both plaintiffs and defendants. His tracked appearances include work for Apple Inc., both defending against SoftView LLC and representing Apple as a plaintiff against SoftView LLC. These engagements indicate a versatile approach to patent disputes, supporting operating companies in asserting and defending their intellectual property rights.

A notable aspect of his practice includes appeals from Patent Trial and Appeal Board (PTAB) decisions. Mr. Hirschfeld represented Apple Inc. as an appellee in SoftView LLC v. Apple Inc. (Fed. Cir. 2024), an appeal concerning the invalidation of patent claims by the PTAB based on IPR estoppel. The Federal Circuit ultimately upheld the validity of the PTAB's estoppel regulation but vacated the application of that regulation to previously issued claims. This case highlights his involvement in the appellate phase of PTAB proceedings.

Mr. Hirschfeld is admitted to practice in New York and is admitted to the U.S. Supreme Court and the U.S. Courts of Appeals for the Federal and Ninth Circuits. He earned his A.B. in English, summa cum laude, from Yale College in 2008 and his J.D. from Yale Law School in 2013. Prior to joining Orrick, he served as a law clerk to Judge Robert Sack of the U.S. Court of Appeals for the Second Circuit and Judge Kimba Wood of the U.S. District Court for the Southern District of New York.
