Andrew P. Zappia

Andrew P. Zappia is a partner at Troutman Pepper Hamilton Sanders, where he serves as the practice group leader for the firm's Health Care + Life Sciences Intellectual Property team. His patent litigation practice is diverse, covering a wide array of technologies and legal venues. Zappia advises clients on intellectual property disputes, licensing, joint development, and commercial transactions.

His patent dispute practice primarily focuses on inter partes review (IPR) proceedings before the Patent Trial and Appeal Board (PTAB), as well as trials and arbitrations related to pharmaceuticals, biotechnology, biosimilars, medical devices, mechanical inventions, and software. Zappia is highly experienced in PTAB practice, having served as litigation counsel in over 40 IPR proceedings, representing both patent owners and petitioners across various technology areas. He is also proficient in other Patent Office proceedings, including ex parte reexaminations, reissues, supplemental examinations, derivation proceedings, and interferences. His work demonstrates a balanced approach, representing both plaintiffs and defendants in patent matters, as evidenced by his tracked appearances.

Among his notable engagements, Zappia was part of the team that secured a PTAB victory for the Broad Institute, Harvard University, and MIT in a patent interference proceeding concerning foundational CRISPR gene-editing technology. In the case Mianyang BOE Optoelectronics Technology Co., Ltd. et al. v. Samsung Display Co., Ltd., which involved OLED display technology, he appeared as counsel for the plaintiff. This district court case, and a related PTAB IPR, were ultimately resolved through a joint stipulation of dismissal with prejudice, with each party bearing its own costs, suggesting a confidential settlement. Additionally, he has served as lead counsel in more than a dozen abbreviated new drug application (ANDA) litigations.

Zappia is admitted to practice in New York, the District of Columbia, and Arizona. He earned his Juris Doctor from the University of Virginia School of Law in 1995, where he was Order of the Coif, and a Bachelor of Arts, summa cum laude, from Tufts University in 1991, where he was Phi Beta Kappa.
