Alexander B. Stein

Alexander B. Stein is a patent litigation partner at Morgan, Lewis & Bockius LLP, where he co-leads the firm's US Patent and Trademark Office (USPTO) Patent Trial and Appeal Board (PTAB) litigation practice. His practice primarily focuses on complex intellectual property disputes, encompassing technologies in diverse areas such as computer science, electrical engineering, human-computer interactions, artificial intelligence (AI), machine learning, extended-reality devices, wireless-power delivery systems, biopotential-signal processing, graphics processing, and mechanical/aesthetics devices. Prior to his legal career, he worked as a senior software engineer in the medical device industry, leveraging this background to understand complex technologies quickly.

With appearances on both sides of patent litigation, Mr. Stein has defended operating companies and prosecuted cases for patent holders, demonstrating a balanced approach with four plaintiff-side and three defendant-side appearances in tracked cases. He counsels clients on patent procurement, enforcement, and defense needs.

Mr. Stein has been involved in several notable cases. He represented HydraFacial LLC in multiple actions, including securing a permanent injunction for HydraFacial in the Central District of California in a patent infringement battle over skin treatment technology, and supported an ITC investigation where HydraFacial's domestic industry and commercial success were affirmed. He also represented Milwaukee Electric Tool Corporation in a dispute against Klein Tools, Inc. concerning modular tool storage systems and tape measures. Furthermore, he represented E-Vision Optics, LLC as a defendant in a patent infringement case regarding eyewear with integrated electronic components, which has seen related inter partes review (IPR) proceedings at the PTAB.

A significant aspect of Mr. Stein's practice is his extensive experience before the PTAB. He has overseen more than 80 America Invents Act (AIA) trial proceedings, including IPRs and reexamination proceedings, and has delivered successful results for both petitioners and patent owners. His PTAB experience includes invalidating challenged claims for a major electronics company and securing denials of institution in multiple IPRs for clients. He has also contributed to thought leadership on PTAB-related topics, including IPR estoppel. Mr. Stein earned his J.D., cum laude, from the University of Michigan Law School in 2014, and an A.B., cum laude, in information science from Cornell University in 2007. He is admitted to practice in California.
