Adam Pivovar

Adam Pivovar is a Partner in Cooley's patent litigation practice, focusing on complex business litigation with an emphasis on patent and technology disputes. His practice spans a diverse range of technologies, including medical products, biotechnology, medical diagnostics, genetically engineered microbes, biofuels, pharmaceutical and biopharmaceutical formulations, clinical PCR devices, chemical and material synthesis and processing, semiconductors, computer software and databases, computer integrated telephone equipment, and teleconferencing. He also has experience in Hatch-Waxman and Life Sciences IP Litigation.

Pivovar primarily represents defendants, as indicated by five of his seven tracked appearances. His notable defense victories include securing a decisive victory for Caihong Display Devices Co Ltd. against Corning in an ITC dispute concerning LCD glass, where an Administrative Law Judge issued an initial determination of non-infringement. He also played a key role in achieving a resounding defense verdict of non-infringement and invalidity in a jury trial for HyperBranch Medical Technologies in a medical device patent litigation in the District of Delaware. Further highlighting his defense work, Cooley successfully lifted a Hatch-Waxman injunction for Liquidia Technologies, enabling the launch of a new drug, and secured a pretrial win and global cross-license for Gevo in a biofuels patent case.

He is actively involved in patent litigation for Cytek Biosciences, Inc. as a defendant in various proceedings, including district court actions and related inter partes review (IPR) and post-grant review (PGR) proceedings against Beckman Coulter, Inc. Pivovar possesses extensive experience in Patent Office Litigation, including IPRs, and has participated in such proceedings, including a PTAB finding of obviousness that benefited his client, HyperBranch Medical Technologies.

Pivovar holds a JD, with honors, from The George Washington University Law School (2006), a PhD in Chemical Engineering from the University of Minnesota (2000), and a BS in Chemical Engineering from the University of Wisconsin, Madison (1995). Prior to his legal career, he was a staff scientist at the National Institute of Standards and Technology (NIST) Center for Neutron Research. He is admitted to practice in California and the District of Columbia, as well as before the Federal Circuit and the U.S. Supreme Court.
