Aashish G. Kapadia

Aashish G. Kapadia is a patent litigation attorney at McDermott Will & Emery, where he is a Partner. He joined McDermott in July 2022 from Baker Botts. Kapadia's practice is strongly focused on the defense of operating companies, with all three of his tracked appearances being on the defendant side.

His technical background in electrical and computer engineering provides a foundation for his work across diverse technologies, including computer hardware, software, telecommunications, semiconductors, and electronic instrumentation. More recently, his practice has expanded to include 3D printing technology, as evidenced by his involvement in SHENZHEN TUOZHU TECHNOLOGY CO., LTD. et al. v. Stratasys Inc..

Kapadia has a notable record in patent litigation, including successfully representing Trustpilot, Inc. in Linfo IP, LLC v. Trustpilot, Inc., where the district court dismissed the patent infringement claims due to patent ineligibility. While on appeal, the case settled, with Trustpilot receiving a worldwide, irrevocable license, and the Federal Circuit subsequently dismissed the appeal as moot.

He possesses significant experience in post-grant proceedings, regularly representing clients in inter partes review (IPR) proceedings at the USPTO. This includes representing clients in IPRs related to memory interfaces, wireless transceivers, fiber optics, power supplies, video decoding, and flash memory, and appearing as backup counsel in IPR2025-00354 involving a networked 3D printer patent. Kapadia earned his JD from The University of Texas School of Law and holds a BS in Computer Engineering from The University of Texas at Austin, and is admitted to practice in Texas.
