Company profile

MPHJ Technology Investments, LLC is a privately held non-practicing entity (NPE) incorporated in Delaware with a principal place of business in Waco, Texas. The company, managed by its sole member Jay Mac Rust, operated through dozens of shell corporations to assert patent rights. MPHJ gained notoriety for its aggressive assertion tactics, which led to it being widely described as a "patent troll."

MPHJ does not manufacture products or provide services. Its business is centered on acquiring patents and generating revenue through licensing and litigation. The company's portfolio included patents related to a "scan-to-email" function commonly found in office equipment. Beginning in 2012, MPHJ sent thousands of demand letters to small businesses across the United States, alleging infringement of these patents and demanding license fees, often calculated on a per-employee basis. This campaign targeted a wide range of small to medium-sized businesses.

As indicated by the case data, MPHJ has acted solely as a plaintiff in patent litigation. The company filed all six of its tracked lawsuits in 2012 and 2013, asserting its patents against large technology and retail companies, including Lexmark, Ricoh, The Coca-Cola Company, and J.C. Penney. Cases were filed in plaintiff-friendly jurisdictions such as the Eastern District of Texas, as well as in Delaware, California, and Vermont. This litigation posture, with zero defensive cases and numerous offensive suits, is characteristic of an NPE focused on patent assertion.

MPHJ's activities drew significant attention from state and federal regulators. The company was investigated by multiple state attorneys general and was the subject of the Federal Trade Commission's (FTC) first consumer protection action against a patent assertion entity. In November 2014, the FTC and MPHJ reached a settlement that barred the company from using deceptive claims and threats in its demand letters. Subsequently, key claims of an MPHJ patent asserted against Ricoh were invalidated by a federal appeals court in 2017.
