Centripetal sued Keysight and IXIA asserting the '370 patent along with U.S. Patent Nos. 9,137,205, 9,413,722, and 9,560,077. A jury trial was held October 2-5, 2018; the parties filed a joint stipulation of dismissal on October 11, 2018, consistent with a settlement, and the case was terminated.
The '722 patent was initially asserted but was not part of the bench trial. The district court entered a roughly $2.75 billion judgment for Centripetal, later vacated by the Federal Circuit due to the judge's failure to recuse; on remand, Judge Hanes found no infringement and the case was closed on May 27, 2025.
Cisco petitioned for inter partes review of claims 1-25 of the '722 patent. The Board instituted review and issued a Final Written Decision finding all challenged claims unpatentable as obvious over the Sourcefire 3D System User Guide; the Federal Circuit affirmed.
