InVue Security Products Inc. sued Mobile Tech, Inc. d/b/a MTI in the Western District of North Carolina in approximately 2015, asserting US 9,269,247; US 9,135,800; and US 8,884,762. The court denied a §101 motion to dismiss on April 14, 2016. This case does not assert US 10,738,508.
InVue filed this suit against Mobile Tech on July 19, 2016, the same day US 9,396,631 issued. It was consolidated into W.D.N.C. No. 3:15-cv-00610 and administratively closed; the consolidated action also asserted US 9,135,800, US 8,884,762, and US 9,269,247 and was transferred to the U.S. District Court for the District of Oregon. The '631 claims were later invalidated in PTAB IPRs and that invalidation was affirmed on appeal.

Mobile Tech/MTI petitioned for inter partes review of US 9,269,247. The Board instituted and consolidated with IPR2016-00899; final written decision found claims 1-37 unpatentable. Affirmed on appeal.
InVue appealed the PTAB final written decisions in IPR2016-00898 and IPR2016-00899 (the '247 patent) and related IPRs. The Federal Circuit affirmed in a Rule 36 per curiam judgment, finally cancelling claims 1-37 of US 9,269,247.
