Walmart/Sam's West sued BJ's alleging infringement of the '435 patent and related patents based on BJ's Express Pay mobile app functionality. The case was stayed pending IPR; after the Federal Circuit affirmed the PTAB decisions, plaintiffs agreed to withdraw the '435 patent counts and continue with the remaining asserted patents.
BJ's petitioned for inter partes review of the '435 patent. The PTAB instituted review and issued a final written decision on April 11, 2024, addressing claims 15-19 and finding prior art anticipation/obviousness. Walmart appealed, and the Federal Circuit affirmed.
Walmart appealed the PTAB's final written decisions in IPR2022-01528, IPR2022-01563, and IPR2022-01564; these appeals were consolidated with 24-1952 as lead (also involving 24-1953 and 24-1954). The Federal Circuit affirmed in a nonprecedential Rule 36 judgment entered April 13, 2026.
