Warren Lipschitz

Warren Lipschitz is a Principal in the Dallas office of McKool Smith, where his practice centers on high-stakes patent infringement disputes and complex commercial litigation. He specializes in intellectual property cases across a diverse range of technologies, including cellular standards (LTE, WCDMA, GSM), video coding standards (H.264), Wi-Fi technology (802.11n), medical devices, and security-related software for cellular phones. Mr. Lipschitz is particularly noted for his expertise in standard essential patents (SEPs), representing major holders like Nokia and Ericsson in disputes over Fair, Reasonable, and Non-Discriminatory (FRAND) licensing terms.

While he represents both plaintiffs and defendants, Mr. Lipschitz has a strong plaintiff-side emphasis, evidenced by his work for SEP holders and recognition among leading global plaintiff lawyers. His tracked case history includes leading plaintiff-side matters for Nokia Technologies Oy against companies such as Acer Inc., Warner Bros. Entertainment Inc., and Paramount Skydance Corp. He has also defended Nokia Technologies Oy against Amazon Com Inc. in patent litigation.

Mr. Lipschitz has a track record of significant trial victories and favorable settlements. He was part of the trial team that secured an $85 million patent damages verdict for WiLAN Inc. against Apple Inc. involving Voice over LTE (VoLTE) technology. He also successfully represented Ericsson in the first breach of FRAND jury trial for cellular patents, where the jury endorsed Ericsson's royalty rate for 4G cellular phones, a verdict upheld by the Fifth Circuit. Additionally, he represented Nokia in a worldwide dispute with Lenovo concerning H.264 video-coding patents, which settled favorably prior to an International Trade Commission (ITC) hearing. Mr. Lipschitz is admitted to practice in Texas, the U.S. District Court for the Eastern District of Texas, and the U.S. Court of Appeals for the Federal Circuit. He earned his J.D. magna cum laude from Northwestern University School of Law in 2011 and holds undergraduate and graduate degrees in civil and structural engineering, having practiced as a licensed Professional Engineer in Texas before his legal career.
