Vivian S. Kuo

Vivian S. Kuo is an accomplished patent litigator with Greenberg Traurig, LLP, where she joined as a shareholder in May 2019 after previously being a partner at Winston & Strawn LLP. Her practice focuses heavily on defending Fortune 100 operating companies and other clients in complex patent disputes in U.S. district courts and before the International Trade Commission (ITC). Her experience spans a wide array of industries, including medical and biomedical devices, surgical methods, semiconductor design and fabrication, computer and network systems, consumer products, information technology, telematics, and automotive electronics. She also possesses experience with antitrust and intellectual property matters involving standard-setting organizations and Hatch-Waxman patent litigations.

Ms. Kuo consistently represents defendants, as indicated by her tracked appearances and notable case work. For instance, she recently represented Hewlett-Packard (HP) in General Video LLC v. Hewlett-Packard, a patent infringement dispute involving six display technology patents, which concluded in January 2026 with a joint dismissal with prejudice. She successfully defended a Swedish manufacturer in an ITC investigation involving nicotine cessation products, positioning the case for an early summary determination that led the complainant to withdraw the complaint. Other significant outcomes include defending a major memory company in the Eastern District of Texas, resulting in a settlement, and prevailing on summary judgment of non-infringement in a case involving telecommunication, software, and automotive technologies, which was later affirmed by the Federal Circuit.

Beyond district court and ITC litigation, Ms. Kuo is experienced with the U.S. Patent and Trademark Office. She has appeared as counsel in Post-Grant Review (PGR) proceedings, specifically representing petitioners Hisense Co. Ltd and LG Electronics, Inc. in IPR2020-01337.

Vivian S. Kuo earned her J.D. from The George Washington University Law School in 1998, an M.S. in Environmental Engineering from The George Washington University in 1995, and a B.S. in Mechanical Engineering from Rensselaer Polytechnic Institute in 1989. She is admitted to practice in the District of Columbia and Virginia and is registered with the U.S. Patent and Trademark Office.
