His notable case outcomes include securing a rare general exclusion order for Fraen Corporation in an ITC investigation involving LED lighting, and a finding of no violation for Winplus North America in an ITC case concerning portable lithium-ion battery jump starters. He was also part of the Desmarais team that achieved a complete victory for Sun Pharmaceutical Industries against Biofrontera in an ITC investigation related to photodynamic therapy medical devices, upholding Sun Pharma's patent rights. Additionally, Mr. Ganguly contributed to a team that secured a $44.9 million jury verdict for IBM against Zynga Inc. for interactive services patent infringement, and an ITC win for OPEX Corporation in warehouse robotics technology, which was affirmed by the Federal Circuit.
While his primary focus is on ITC and district court litigation, Mr. Ganguly's firm, Desmarais LLP, maintains a Patent Trial and Appeal Board (PTAB) practice, and he is familiar with the interplay between ITC and PTAB proceedings. He is admitted to the State Bars of California and Washington, D.C., and is registered to practice before the U.S. Patent and Trademark Office. He earned his J.D. and a B.A. in biology from Washington University.
