Timothy P. Getzoff

Timothy P. Getzoff is a seasoned patent litigator and partner at Holland & Hart LLP, where he has practiced since 1996 and became a partner in 2004. His intellectual property practice is broad, encompassing high-stakes patent, trademark, and copyright litigation across the United States. Getzoff's technological experience spans diverse areas including remote sensor technology, GPS and embedded firmware applications, computer data storage hardware and software, WiFi design and deployment, telecommunications, consumer packaged goods, sporting goods, and electronics. His firm's patent team also focuses on next-generation technologies like wireless communications, memory technology, artificial intelligence, cloud computing, wearable health devices, and standard essential patents.

In his litigation practice, Mr. Getzoff primarily represents defendants, as evidenced by his appearances in tracked cases and numerous client successes detailed in his professional profile. He served as lead counsel for defendants in two notable recent patent infringement cases, RARE BREED TRIGGERS, INC. et al. v. PEAK TACTICAL LLC and RARE BREED TRIGGERS, INC. et al. v. TACTICAL DEPLOYMENT SYSTEMS, LLC, DBA GUNFIGHTER. In the Peak Tactical matter, the court denied Rare Breed Triggers' motion for a temporary restraining order and preliminary injunction, allowing the defendant to continue manufacturing and selling its product, despite a claimed $588 million in damages by the plaintiff. This denial was a significant procedural victory for his client, with the court noting Rare Breed failed to demonstrate immediate, irreversible harm or clear-cut infringement.

His experience extends to achieving favorable outcomes in other complex patent disputes. For instance, he successfully invalidated a patent before the Patent Trial and Appeal Board (PTAB) in LMT Mercer Group, Inc. v. Homeland Vinyl Products, Inc. (D. New Jersey 2020), which led to the dismissal of the related litigation. He also secured a judgment of non-infringement for defendants in cases such as Hero Nutritionals v. Nutraceutical Corp. (C.D. California 2013) and Aceto Agricultural Chem. v. Bayer Crop Sciences (S.D.N.Y. 2012), with the latter being affirmed by the Second Circuit. Getzoff is noted for his involvement in proceedings before the PTAB, the Trademark Trial and Appeal Board, the International Trade Commission, and appeals before various Circuit Courts, including the Federal Circuit.

Mr. Getzoff earned his J.D. from the University of Colorado School of Law in 1996, where he was Order of the Coif and served on the Law Review Editorial Board. He received his B.A. in Political Science from the University of California - Berkeley in 1990. He is admitted to practice in Colorado and has a pending admission in Utah.
