Timothy J. Carroll

Timothy J. Carroll is a highly experienced patent litigator focusing on high-stakes intellectual property disputes for innovators in the technology and life sciences sectors. His practice encompasses a broad range of cutting-edge technologies, including mobile applications, location-based services, messaging systems, medical devices, content-management platforms, Wi-Fi-enabled thermostats, green technologies, and other IoT innovations. He also handles trade secret disputes involving military weaponry and defense systems, aerospace products, and financial technologies.

Mr. Carroll primarily represents operating companies as a defendant, often leading joint defense groups for large and sophisticated clients. His track record includes first-chair trial wins in federal courts and the International Trade Commission (ITC), and he has prevailed in appeals before the Federal Circuit.

Currently a partner at Orrick, Herrington & Sutcliffe LLP, Mr. Carroll joined the firm's IP litigation practice in January 2024, based in Chicago and also spending time in Washington, D.C. Prior to Orrick, he was a partner at Venable LLP, which he joined in July 2021. During his tenure at Venable, he served as lead counsel for ecobee, Inc. in an ITC investigation, Ecofactor, Inc. v. ecobee, Inc., securing an initial determination of no patent infringement and invalidity of the asserted patents in April 2022. He has extensive experience in inter partes reviews (IPRs) and other post-grant proceedings, and has appeared as counsel for ecobee, Inc. in Federal Circuit appeals stemming from PTAB decisions.

Mr. Carroll earned his legal training from DePaul University College of Law, graduating and becoming licensed to practice law in 1999.
