Tia Fenton

Tia Fenton is a patent litigation partner at Duane Morris LLP, where she joined in January 2023. Previously, she was a partner at Oblon, McClelland, Maier & Neustadt, L.L.P.. Her practice focuses on complex patent matters for both domestic and foreign companies, with a primary emphasis on chemical, biochemical, biomedical, and pharmaceutical cases, including ANDA litigation. Ms. Fenton also has experience litigating in other technical areas such as cable splicing, optics, and streaming devices, drawing on her background in chemistry, biochemistry, and genetics.

Ms. Fenton predominantly represents defendants, advising clients on pre-litigation and litigation strategies, due diligence, freedom to operate, licensing, and patent portfolio protection. A notable outcome includes securing a complete non-infringement jury verdict for Roku in IOENGINE, LLC v. Roku, Inc. (Case No. 6:21-cv-01296-ADA) in Waco, Texas, where the plaintiff had sought $318 million. This case aligns with her role as lead attorney in the tracked VideoLabs, Inc. v. Roku, Inc. matter. She has also been shortlisted for Litigator of the Year in the D.C. Metro area at the 2025 Managing IP Americas Awards.

Her experience extends to post-grant proceedings before the USPTO, where she counsels clients on their strategic use in conjunction with district court litigation. Ms. Fenton's career also includes prior experience as a forensic DNA analyst and examiner, during which she served as an expert witness in DNA identification testing and testified in numerous trials.

Ms. Fenton earned her J.D. from George Mason University School of Law in 2004, an M.S. in Forensic Science and DNA Technologies from Marshall University, and a B.S. in Chemistry from Wheeling Jesuit University.
