ThucMinh Nguyen

ThucMinh Nguyen is a partner at Kasowitz Benson Torres LLP, specializing in intellectual property litigation, particularly patent and trademark infringement, and commercial litigation. Her practice involves representing global technology, media, and telecommunications companies. She joined Kasowitz in August 2018, having previously served as General Counsel and Professional Staff Member for Senator John McCain on the Senate Armed Services Committee.

Nguyen's patent litigation experience covers diverse technology areas, including in-flight connectivity (Wi-Fi and satellite internet), computer architecture, software, and agricultural machinery and control systems. Her case history demonstrates a balanced practice, representing both plaintiffs, such as Intellectual Ventures, and defendants, including operating companies like American Airlines, Southwest Airlines, Deere & Co., and AsusTek Computer.

Among her notable engagements, Nguyen has represented Intellectual Ventures in significant patent infringement lawsuits against major airlines. In a case against American Airlines concerning in-flight connectivity, the court denied American's motion to sever and stay claims and ordered the production of pre-suit discovery, including technical documents and source code. She also represents Intellectual Ventures in actions against Deere & Co. On the defense side, she was part of the Kasowitz team that secured a rarely granted stay in a patent infringement case for AsusTek Computer in the Western District of Texas. Her practice also entails exposure to Inter Partes Review (IPR) proceedings, as related district court litigations, such as those involving Intellectual Ventures and the airlines, have generated parallel IPR challenges.
