Thomas DaMario

Thomas DaMario is a patent litigator at Benesch Friedlander Coplan & Aronoff, specializing in complex intellectual property litigation and transactions, particularly patent infringement and trademark cases. His practice spans district courts, the International Trade Commission, and the Patent Trial and Appeal Board. With an educational background in electrical engineering and six years of prior experience as an engineer contributing to industry standards in cybersecurity, cryptography, access control, and intrusion detection systems, he handles cases involving internet technologies, wireless and cellular communications, semiconductor chip design and fabrication, power tools, computer and networking systems, and mechanical devices.

In his tracked appearances, Mr. DaMario has primarily worked on the defendant side, defending operating companies. For instance, he served as counsel for ASUSTeK Computer, Inc. in Force MOS Technology v. ASUSTeK Computer, Inc. et al.. This case, litigated in the Eastern District of Texas, involved allegations of infringement concerning chip technology patents, specifically MOSFETs and transistor designs used in integrated circuits for consumer electronics. The jury ultimately found ASUSTeK liable for willful infringement and awarded $10.5 million in damages to Force MOS Technology. Benesch also represented ASUSTeK in a subsequent federal patent appeal related to this matter.

Mr. DaMario is also experienced with PTAB proceedings and related issues, as evidenced by his practice description which includes the Patent Trial and Appeal Board, and by articles he has authored concerning PTAB topics. He earned his J.D., magna cum laude, from DePaul University College of Law in 2017, where he was Order of the Coif and received a Certificate in Patent Law, and holds a B.S. in Electrical Engineering from the University of Illinois – Urbana-Champaign (2008). He is admitted to practice in Illinois, before the United States Patent and Trademark Office, the U.S. Court of Appeals for the Federal Circuit, and the U.S. District Courts for the Northern District of Illinois and the Eastern District of Texas. He is also a licensed Professional Engineer.
