Thad C. Kodish

Thad C. Kodish is a seasoned patent litigation attorney and a Principal in the Atlanta office of Fish & Richardson P.C., where he has served as managing principal since 2011. His practice primarily focuses on defending operating companies against patent infringement allegations, often involving non-practicing entities (NPEs) or "patent trolls." With an educational background in chemical engineering, Mr. Kodish handles a diverse range of technologies, including software for wireless communication devices, medical devices (such as otolaryngology and laryngoscope technologies), agrochemical formulations, cryptographic technology, and fitness tracking devices.

Mr. Kodish has a strong track record of securing favorable outcomes for his clients, including wins on summary judgment, at trial, and on appeal. Notably, he led a team to a January 2025 defense verdict in the Eastern District of Texas in Headwater Research, LLC v. Samsung Electronics, Inc. et al., successfully countering a $2 billion demand in a case concerning data and power saving software for wireless communication devices. He also achieved a complete victory for Tide International, USA in UPL NA, Inc. v. Tide International (USA) Inc., where his team invalidated asserted patent claims through inter partes review (IPR) proceedings at the USPTO, a decision later affirmed by the Federal Circuit. His work for Samsung in Ward Participations BV v. Samsung Electronics Co., Ltd., et et al. also resulted in invalidity findings for cryptographic technology patents through IPRs, affirmed on appeal. He was also involved in the defense of Wahoo Fitness, LLC in Blackbird Tech LLC v. Wahoo Fitness, LLC, which involved patents related to pedometer technology.

He possesses significant experience with PTAB and IPR proceedings, where he has successfully challenged patents, leading to district court case dismissals and affirmations by the Federal Circuit. Mr. Kodish is admitted to the Georgia Bar (2000) and earned his J.D. from Emory University School of Law (2000) and a B.S., cum laude, in chemical engineering from the University of Michigan (1996).
