Stephen Elliott

Stephen J. Elliott is a Special Counsel in Sullivan & Cromwell's Intellectual Property and Technology Group, focusing on patents and intellectual property litigation. His practice encompasses a broad range of technologies, including pharmaceuticals, optics, electronics, software, medical devices, biotechnology, and financial services. Notably, he has co-authored a chapter on software patent litigation for IAM's The Patent Litigation Review.

Elliott has experience representing both plaintiffs and defendants in patent disputes. His recent tracked appearances include defending Security First Innovations LLC against Unified Patents PTAB Data and International Business Machines Corporation. In a significant outcome, he was part of the Sullivan & Cromwell team that secured a noninstitution on behalf of Security First Innovations, LLC, where the Patent Trial and Appeal Board (PTAB) denied Google LLC's petition for inter partes review challenging a Security First patent. His work also includes representing clients like Pfizer and Bristol-Myers-Squibb in antitrust class actions related to patent litigation, and securing patent trial victories for clients such as Columbia University and Ocado Group plc.

His experience extends to Patent Trial and Appeal Board (PTAB) proceedings, as evidenced by his role in the Security First Innovations IPR and co-authoring a Law360 article analyzing Federal Circuit decisions impacting the PTAB. Elliott is registered to practice before the United States Patent and Trademark Office.

Elliott is admitted to the New York bar. He earned his J.D. from UC Berkeley School of Law in 1995 and an S.B. in Chemical Engineering from M.I.T. in 1983. Before his legal career, he worked as a process and materials engineer for Intel Corporation, developing integrated circuit manufacturing technology.
