Siegmund Y. Gutman

Siegmund Y. Gutman is a nationally recognized patent litigator specializing in life sciences, with a deep focus on biologic drug patents, the Hatch-Waxman Act, biosimilars, and generic drugs. His practice encompasses a broad range of technologies, including therapeutic proteins like monoclonal antibodies and antibody-drug conjugates, nucleic acids, gene therapy, stem cells, and small molecules. Drawing on an extensive background in molecular and cell biology and biophysical chemistry, Mr. Gutman primarily represents operating companies, advising them on market exclusivity, freedom-to-operate strategies, and defending their intellectual property assets.

Currently, Mr. Gutman serves as Chair of the Life Sciences Litigation Practice and Co-chair of the Patent Litigation and Life Sciences Practices at Mintz, Levin, Cohn, Ferris, Glovsky and Popeo (Mintz). He joined Mintz in May 2024, leading a team of life sciences patent litigators from Proskauer Rose LLP, where he previously chaired the Life Sciences Patent practice for over a decade. His prior firm experience also includes roles as a partner at DLA Piper and Bingham McCutchen. Before entering private practice, he gained over 20 years of industry experience, notably as senior patent litigation counsel for Amgen, Inc.

Mr. Gutman has a strong track record, including his role as lead counsel for Amgen Inc. in Regeneron Pharmaceuticals, Inc. v. Amgen Inc., a significant case involving the Biologics Price Competition and Innovation Act (BPCIA) where he defended Amgen's biosimilar products. He also achieved a notable outcome representing Sanofi and SK Chemical in a Federal Circuit appeal against Pfizer, Inc., which resulted in the invalidation of all 45 claims of a key Pfizer patent related to pneumococcal conjugate vaccines. His expertise extends to inter partes patent office actions, and he regularly represents clients before the Patent Trial and Appeal Board (PTAB), U.S. District Courts, and the Federal Circuit.

Admitted to the State Bar of California since 2010, Mr. Gutman is also licensed in the District of Columbia and Illinois, and admitted to practice before the United States Court of Appeals for the Federal Circuit and various U.S. District Courts. He holds a B.A. from the University of California, Santa Cruz, a D.Phil. and M.A. in Molecular and Cell Biology from the University of California, Berkeley, and a J.D. from the University of Illinois College of Law.
