Sidney Calvin Capshaw, III

Sidney Calvin Capshaw is a seasoned patent litigator with a practice primarily focused on representing patent owners in intellectual property disputes. His experience spans a range of technologies, including streaming media, signal processing, content delivery networks, and semiconductor devices, such as DRAM and fabrication technologies. His case history also touches upon display technologies and automotive applications, as seen in disputes involving major technology and automotive companies. Capshaw has consistently worked on the plaintiff side in the majority of his tracked cases (6 out of 8), indicating a preference for prosecuting patent infringement claims, often for patent assertion entities (PAEs).

Capshaw is a founding partner of Capshaw DeRieux, L.L.P., a Gladewater, Texas-based firm established in 2008. The firm's practice areas emphasize complex commercial and intellectual property litigation. Before co-founding Capshaw DeRieux, he was a partner at Brown McCarroll, LLP, and Sharp, Ward, Price & Searcy, both in Longview, Texas. Capshaw earned his Doctor of Jurisprudence from Baylor University School of Law in 1986. Among his notable engagements, Capshaw served as Of Counsel in Personalized Media Communications, LLC v. Netflix, Inc., a case involving adaptive streaming technology which ultimately resulted in a stipulated dismissal with prejudice in January 2024. He was also involved in the Federal Circuit appeal Google LLC v. Personalized Media Communications, LLC, addressing the patentability of signal processing methods, which concluded with a voluntary dismissal by both parties. In Mosaid Technologies Inc. v. Infineon Technologies AG et al., a dispute over semiconductor IP, a settlement was reached that included a licensing agreement for Mosaid's patent portfolio. Capshaw was lead counsel for the plaintiff in Innovative Display Technologies LLC v. BMW of North America, LLC. He also represented Greenthread LLC as a partner in its litigation against Texas Instruments Incorporated, a case which has seen related inter partes review (IPR) proceedings at the Patent Trial and Appeal Board (PTAB). This involvement indicates experience defending patent owner interests in PTAB proceedings.
