Shyam Shanker

Shyam Shanker is an Of Counsel at Dechert, specializing in life sciences patent litigation, particularly Hatch-Waxman disputes. His practice also encompasses patent litigation for technology companies. While his tracked appearances include representation on the defendant side, his experience demonstrates a versatile approach, having also represented innovative plaintiffs in significant patent disputes.

Mr. Shanker's notable engagements include representing Dana-Farber Cancer Institute in patent litigation against AstraZeneca concerning U.S. Patent No. 9,402,899, which resulted in a favorable settlement for Dana-Farber. He also represented various StoneCastle entities in patent and trade secret litigation, successfully securing the dismissal of five asserted patents as ineligible under 35 U.S.C. § 101 on a motion to dismiss, followed by a favorable settlement after a Federal Circuit appeal. Additionally, Mr. Shanker successfully represented Advanced Accelerator Applications SA in Post-Grant Review (PGR) proceedings before the Patent Trial and Appeal Board (PTAB), where institution was denied on all three petitions.

He possesses experience with proceedings before the Patent Trial and Appeal Board (PTAB) and appellate proceedings at the U.S. Court of Appeals for the Federal Circuit. Mr. Shanker earned his Juris Doctor from Columbia Law School in 2018, where he was a Harlan Fiske Stone Scholar, and holds a Bachelor of Science in Biology and a Bachelor of Arts in Political Science from the University of Georgia, received in 2014.
